Terms & Conditions of Rental for WeAuto:

These Terms and Conditions of Rental (“Terms”) govern your use of the car rental services provided by WeAuto (referred to as “WeAuto,” “we,” “us,” or “our”), including bookings made through our website weauto.ma and the physical rental of vehicles. By making a booking or renting a vehicle from WeAuto, you (“Renter,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund and Returns Policy, both of which are incorporated by reference herein.
Please read these Terms carefully before proceeding with your rental.
1. Eligibility for Rental
1.1. Minimum Age: The Renter and any authorized additional drivers must be at least [e.g., 21 / 23 / 25] years old. For certain vehicle categories (e.g., luxury or high-performance cars), a higher minimum age may apply, and this will be specified at the time of booking. Renters under the age of [e.g., 25] may be subject to a “Young Driver Surcharge,” which will be clearly communicated at the time of booking or pickup.
1.2. Valid Driving License: The Renter and any authorized additional drivers must possess a valid driving license held for a minimum of [e.g., 1 or 2] years. * For Moroccan residents, a valid Moroccan driving license is required. * For international visitors, a valid driving license from their country of residence is required. If the license is not in Latin characters (e.g., Arabic, Chinese, Japanese), an International Driving Permit (IDP) or a certified translation in Arabic or French is mandatory. * Provisional licenses are not accepted.
1.3. Valid ID: A valid National ID Card (for Moroccan residents) or Passport (for international visitors) is required for identification purposes.
1.4. Credit Card: The Renter must present a valid credit card in their own name at the time of vehicle pickup. This credit card will be used for the security deposit and any additional charges not covered by the prepaid rental amount. Debit cards may not be accepted for the security deposit.
1.5. Fitness to Drive: The Renter and any authorized additional drivers must be medically fit to drive and must not be under the influence of alcohol, drugs, or any other substance that impairs driving ability.
2. Booking and Reservation
2.1. Booking Confirmation: A booking is confirmed upon receipt of a confirmation email from WeAuto. This confirmation will include details of your rental, including vehicle type, rental dates, pickup/drop-off locations, and total cost.
2.2. Vehicle Availability: While we strive to provide the exact vehicle booked, all bookings are for a vehicle category ( “Economy,” “SUV,” “Luxury”). WeAuto reserves the right to substitute a vehicle of similar size and category, or a higher category, if the booked vehicle is unavailable. No extra charge will apply for an upgrade.
2.3. Pricing: Rental prices include the basic rental rate, basic insurance (as specified), and local taxes. Additional services ( GPS, child seats, additional drivers) and optional insurance coverage are charged separately. Prices are subject to change without prior notice until a booking is confirmed.
2.4. Payment: Full payment for the rental period (or a non-refundable deposit as specified) is required at the time of booking. Any remaining balance, additional services, or security deposit will be processed at the time of vehicle pickup.
3. Pickup and Drop-off
3.1. Pickup: * The Renter must pick up the vehicle at the agreed-upon date and time at the specified WeAuto location. * The Renter must present all required documentation: valid driving license, valid ID/passport, and the credit card used for the security deposit (in the Renter’s name). Failure to provide required documents may result in cancellation without refund. * A joint inspection of the vehicle will be conducted by the Renter and a WeAuto representative at pickup. Any existing damages will be noted and signed off on the Vehicle Condition Report. The Renter is responsible for verifying the accuracy of this report before taking possession of the vehicle.
3.2. Drop-off: * The Renter must return the vehicle at the agreed-upon date, time, and location specified in the rental agreement. * A joint inspection of the vehicle will be conducted by the Renter and a WeAuto representative at drop-off to identify any new damages. * Late Returns: A grace period of [ 59 minutes] is allowed. Returns exceeding the grace period will be subject to an extra day’s rental charge at the prevailing daily rate, plus any applicable late return fees. Please notify us immediately if you anticipate a late return. * Early Returns: No refunds will be issued for unused rental days if the vehicle is returned earlier than the agreed drop-off time.
4. Security Deposit
4.1. A security deposit, the amount of which will be specified at the time of booking and pickup, will be authorized on the Renter’s credit card. This deposit is held as a guarantee for the due performance of the rental agreement, including but not limited to, potential damages, additional charges (e.g., fuel, cleaning, late return fees), traffic fines, or violations of these Terms.
4.2. The security deposit will be released upon the satisfactory return of the vehicle, typically within 3-5 business days after drop-off. The exact time for the release to reflect in your account may vary depending on your bank.
4.3. WeAuto reserves the right to deduct from the security deposit any amounts due under these Terms or the rental agreement. If charges exceed the security deposit, the Renter authorizes WeAuto to charge the additional amount to the credit card on file.
5. Insurance and Liability
5.1. Basic Insurance: All rentals include basic Third-Party Liability (TPL) insurance as mandated by Moroccan law, covering damages to third parties and their property. This insurance does not cover damages to the rented vehicle, theft of the vehicle, or personal injuries to the Renter or authorized drivers.
5.2. Renter’s Liability for Damages/Theft: The Renter is fully responsible for any damages to the rented vehicle (regardless of fault), loss, or theft of the vehicle during the rental period, up to the full value of the vehicle, unless additional insurance coverage is purchased.
5.3. Optional Insurance Coverage: WeAuto offers various optional insurance coverages (e.g., Collision Damage Waiver (CDW), Super CDW, Theft Protection (TP), Personal Accident Insurance (PAI)) that can reduce or waive the Renter’s financial liability for damages to the rented vehicle or its theft. Details and associated costs for these options will be provided at the time of booking or pickup. It is highly recommended that Renters consider purchasing additional coverage.
5.4. Exclusions to Insurance Coverage: Insurance coverage (basic or optional) may be voided, and the Renter will be fully liable for all damages, loss, or theft, if: * The vehicle is driven by an unauthorized driver. * The vehicle is driven off-road or in unauthorized areas. * The vehicle is used for illegal purposes, racing, towing, or commercial purposes (unless agreed upon). * The Renter is under the influence of alcohol, drugs, or any other intoxicating substance. * The Renter fails to report an accident to WeAuto and local authorities immediately. * Damage is caused by gross negligence or willful misconduct of the Renter. * Damage is caused by improper use of fuel. * Interior damage, tire damage, hubcaps, keys, or lost items are not covered by standard waivers.
5.5. Accident Procedure: In the event of an accident, the Renter must: * Ensure the safety of all parties involved. * Notify the local police (19 for police, 15 for fire/ambulance) immediately and obtain a police report. * Notify WeAuto immediately (+212663765838). * Not admit fault or liability to any third party. * Obtain names, addresses, and phone numbers of all parties involved and witnesses. * Not leave the scene of the accident without a police report.
6. Use of the Vehicle
6.1. Authorized Drivers: Only the Renter and authorized additional drivers listed on the rental agreement are permitted to drive the vehicle. An additional driver fee may apply.
6.2. Prohibited Uses: The rented vehicle must not be used for: * Carrying more passengers than legally allowed. * Carrying flammable, explosive, or other hazardous materials. * Illicit or illegal purposes. * Pushing or towing any other vehicle, trailer, or object. * Racing, rallies, or any form of competition. * Driving on unpaved roads, tracks, or areas not designed for public vehicle access. * Sub-renting or lending the vehicle to any third party. * Driving outside the borders of Morocco without prior written authorization from WeAuto.
6.3. Maintenance and Care: The Renter must take all reasonable care of the vehicle, including checking fluid levels, tire pressure, and lights during the rental period. Any warning lights should be reported to WeAuto immediately.
6.4. Smoking: Smoking is strictly prohibited inside all WeAuto vehicles. A cleaning fee will be charged if evidence of smoking is found.
7. Fuel Policy
7.1. The vehicle will be provided with a [e.g., full] tank of fuel at pickup. 7.2. The Renter must return the vehicle with a [e.g., full] tank of fuel. 7.3. If the vehicle is returned with less than the agreed fuel level, the Renter will be charged for the missing fuel at our prevailing rate per liter, plus a refueling service charge of 50 MAD / €5 / $5. No refund will be given for excess fuel.
8. Traffic Fines and Penalties
8.1. The Renter is solely responsible for all traffic violations, parking fines, tolls, and other penalties incurred during the rental period.
8.2. WeAuto will charge an administrative fee of 100 MAD / €10 / $10 for processing each fine or penalty received on behalf of the Renter, in addition to the fine amount itself.
9. Jurisdiction and Governing Law
9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Morocco.
9.2. Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the competent courts in [fes, Morocco].
10. Personal Data Protection
10.1. WeAuto collects and processes your personal data in accordance with our Privacy Policy and Moroccan Law n° 09-08 of 18 February 2009 relating to the protection of individuals with regard to the processing of personal data, and GDPR where applicable.
10.2. By agreeing to these Terms, you consent to the collection, use, and disclosure of your personal data as described in our Privacy Policy.
11. Limitations of Liability
11.1. WeAuto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your rental, even if WeAuto has been advised of the possibility of such damages.
11.2. WeAuto is not responsible for any personal items left in the vehicle after drop-off. The Renter is solely responsible for ensuring all personal belongings are removed from the vehicle. While we will endeavor to contact you if items are found, we cannot guarantee their return.
11.3. Our total liability to you for any and all claims arising out of or in connection with these Terms or your rental shall not exceed the total rental charges paid by you.
12. Amendments to Terms
12.1. WeAuto reserves the right to amend or update these Terms at any time without prior notice. The updated Terms will be effective upon posting on our website. It is the Renter’s responsibility to review these Terms periodically. For existing confirmed bookings, the Terms in effect at the time of booking will generally apply, unless an update is required by law.
13. Severability
13.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall remain in full force and effect.
14. Entire Agreement
14.1. These Terms, together with the Rental Agreement, Privacy Policy, and Refund and Returns Policy, constitute the entire agreement between the Renter and WeAuto concerning the rental of the vehicle and supersede all prior or contemporaneous communications, understandings, and agreements, whether oral or written.
